The following terms and conditions shall apply to and are incorporated into the quotation. They shall apply unless expressly modified or excluded in writing and signed by the contractor TURFIT.
1. The term "client" shall mean the person or persons named on the quotation who will be responsible for all payments to the contractor unless otherwise notified in writing prior to commencement.
2. The client to provide water and electricity at no charge to the contractor.
3. The client shall provide access to the site and storage space for materials at all times during the works' progress.
4. Any additions or alterations to the schedule shall be properly treated as variations and subject to written instructions.
5. The contractor is not able to accept responsibility for any damage to (or cost involved with) any underground hazard, obstructions or services not made known to us in writing or by apparent visual inspection.
6. A mobilisation payment of 25% of the value of the quotation is payable upon commencement. Stage payments against works completed and materials on site are to be made payable when required within three days of date of invoice. A final payment is to be made following practical substantial completion of the ground works and is payable within 10 days of date of invoice, otherwise the balance due will be subject to a credit surcharge of 5% per month thereafter until paid in full.
7. The price quoted is to remain fixed for a period of 30 days from the date of quotation. Acceptance within this 30 day period will ensure no increase in the cost of the works specified. After this period the quotation may be subject to revision.
8. All or any special conditions are noted in the quotation.
9. A cancellation fee equal in value to 25% of the price quoted is payable should the client withdraw from the agreed contract.
10. The contractor is not able to accept responsibility for any subsequent detrimental effects due to the natural conditions occurring including wind, rain, frost, sun and shade following practical substantial completion.
11. Annual Meadow Grass and Yorkshire Fog is present to varying degrees in all lawns new and old. There is NO legally permitted chemical control available. Similarly, there is NO legally permitted chemical control of Leatherjackets and Chafer Grubs.
12. Ownership of property in the form of materials or goods supplied by the contractor as part of the contract will pass to the client when said materials or goods have been paid for in full. The contractor shall have the right of entry on to the site for the purpose of retrieving said materials until such time as payment has been made in full.
